he is seeking bail. he can not completely exclude premeditated murder. pistorius was sobbing. his defense denies the killing was premeditated and argued that reeva steenkamp's death was not even murder. the prosecution maintains pistorius put on his prosthetic limbs and walked 20 feet and then shot through a locked bathroom door killing steenkamp. there are huge crowds of people trying to snag a seat inside the courtroom. >> the big news there is the magistrate in south africa ruling that they are going to go ahead with this case accusing him of premeditated -- premeditated murder. the magistrate saying he cannot rule out that possibility. as this is happening, as he is being denied bail in that courtroom in south africa, oscar pistorius' girlfriend reeva steenkamp is being laid to rest along the southern coast of south africa. we have a reporter live from

port elizabeth near the site of steenkamp's funeral. >> i'm standing outside victoria park crematorium in port elizabeth in the eastern cape where friends and family of reeva steenkamp have gathered to pay their last respects and more than a thousand kilometers from here at the magistrate court. oscar pistorius is appearing in a court of law accused her murder. state prosecutors are arguing this is premeditated murder saying that oscar pistorius armed himself, attached his legs and shot her repeatedly through a bathroom door. oscar pistorius' defense is saying he thought she was a burglar. the arguments went out in the morning with oscar pistorius sobbing uncontrolably at times. here people just want two answers, why did this happen to a person they describe as kind

manifesto and gave its reasons behind the attack. it claimed that the u.s. was carrying out an imperialistic agenda in the middle east. there was a deployment of u.s. anti-missile patriot missile batteries deployed in the last month in turkey to protect turkish cities from the war in neighboring syria. this group accused the u.s. of trying to colonize syria sits environmental. the irony here is that the rebels inside syria are very angry at the u.s. for not providing enough support, not providing them weapons in their battle against. that story for us. >> all right. 34 minutes past the hour. law enforcement sources saying new town gunman adam lanza was driven by violent video games, an obsession to kill more people than anders breicik who murdered 77 people in norway in 2011. lanza targeted sandy hook elementary school because it was the easiest target with the largest cluster of people. 20 children and six adults died at sandy hook. connecticut police dismiss the cbs report calling it speculation. >> new limits on police presence in city schools. today police in denver public school officials will sign an agreement that specifically denies when police officers should step in and when educators should handle problems with students. they're honiping the agreement will cut down on the number of denver students ticketed or arrested in school. drew peterson will be in court today making a last ditch bid for a new trial.

peterson was convicted of first-degree murder in the 2004 bathtub drowning of his third wife, kathleen save yoe. sentencing is set for tomorrow. the 69-year-old peterson faces 20 to 60 years in prison. his fourth wife stacy peterson, by the way, is still missing. >> officials in japan discovered a problem in a second battery onboard a boeing 787 dreamliner that was forced to make an emergency landing last month after its main battery failed. officials say a slight swelling was found in the auxiliary power unit's battery cells. the faa grounded all 50 dream liners following the incident in japan and a battery fire in a boeing 787 parked on the tarmac at boston's logan airport. investigatesors are trying to figure out what caused a fire that killed three young children in an apartment fire. this is in michigan. authorities say the children -- oh, my goodness, 3-year-old twins and a 1-year-old girl may have been left alone in the

apartment by their parents. the parents of a pregnant 16-year-old texas girl who tried to force their daughter to get an abortion have had a change of heart after she took them to court. they gave her permission to carry the baby and marry the father. madison spoke last night to cnn's piers morgan. >> i knew it wasn't going to be easy at all. but i really didn't imagine this all happening. but i knew that some of her parents, many of her family were going to have a definitely a negative reaction. but i never intended on this happening. we're always determined to have a baby. >> the girl claimed her mother threatened to slip her an abortion pill and took away her phone and car to pressure her into aborting that child. >> florida's big python hunt is over. the final talley is -- incredibly underwhelming. more than 1600 people took part in the everglades python

this just in. new information from a courtroom in south africa. the charge against olympic icon oscar pistorius has been upgraded to premeditated murder. the judge at his bail hearing under way right now said he could not exclude the possibility of premeditation. and planning in the shooting death of his girlfriend reeva steenkamp. the prosecution argued that pistorius killed steenkamp and it was murder and it was premeditated. so this really makes it very unlikely that pistorius will get bail. the judge did not rule out downgrading the charge, perhaps later. major developments. those just now. also happening right now, a desperate search for a missing fishing boat and five crew members. canadian officials say the miss alley set out an emergency signal sunday night. they report seeing a life raft yesterday morning. they're not sure if anyone was in it. and they lost sight of it. chuck hagel is hoping a letter he sent to the biggest

let's get you up to date. here is christine romans with a lot of our top stories. a court upgraded the charges against blade runner oscar pistorius to premeditated murder. we're still waiting to hear a ruling on his request for bail. but this ruling makes it very unlikely. the olympic star sobbing this morning as his defense team denied his girlfriend's killing was premeditated. they maintained reeva steenkamp's death was not even murder. the prosecution says pistorius put on his prosthetic limbs, walked about 20 feet and then shot through a locked bathroom door killing steenkamp. as pistorius is in court, reeva steenkamp's family will lay her to rest. her funeral happening on the southern coast of south africa

unlikely pistorius will be granted bail. the hearing going on. our reporter in the courtroom, says pistorius was sobbing, breaking down while his team angled for bail. at one point, they argued steenkamp's death was not even murder. their words. all of this with an unprecedented crush of cameras at the courtroom and a huge amount of people trying to get seats in the courtroom. up in the next half hour, more on the decision with cnn's legal contributor paul callan. the girlfriend of oscar pistorius, reeva steenkamp, being laid to rest. family and friends gathering on the southern coast of africa. we are joined from near the site of her funeral. >> reporter: hello, john. it was really emotional morning here at victoria park creme for

mass murderer by killing more than the 77 people. the majority of them teenagers shot by ander s breivic in k. the possible motive briefed last week. the possible motive has to do with what was found in lanza's home. several news articles found in one of lanza's two bedrooms in the house where he lived with his mother. she was his first victim and he went on to kill 20 children and six teachers before taking his own life when police arrived. lanza chose the school because of the number of potential targets in a closed-in setting. a spokesperson called the cbs report speculation, no motive confirmed. but the spokesman told me as far as duplicated breivik and the massacre in norway, nothing is

reeva steenkamp. the court is taking a break for lunch right now. robyn curnow in the courthouse as this is developing. >> can i read a direct quote from the magistrate. he armed himself, the motive was he wanted to kill. that's the -- the state arguing that oscar pistorius in a planned and premeditated way shot his girlfriend reeva steenkamp. quite dramatic testimony coming from the state. they kind of laid out a little bit of the evidence they had. not all of it, and they said they didn't need to say very much. for them, the facts were facts. a very simple case. they were quite confident, i must say, in court. oscar had picked up his gun, put on his prosthetic legs, walked about seven meters to a bathroom where his girlfriend was locked

inside, and he shot four bullets through there, as she was hit three times. now they said basically substituted premeditated murder. the magistrate agreeing with him, saying that the defense really didn't disprove their argument, and he is saying oscar pistorius has to face the higher charges. now has to be exceptional circumstances proved by the defense. if he's even to get bail. >> so right now, the magistrate broke for lunch, and when you are back in court, should we know whether or not he has been granted bail. any likelihood he would be granted bail? >> well, this makes it very hard for him to get bail and this sort of legal pigeonhole that they have now ruled this under. section 6 and i'm totally not going to bore you with the legal jargon. this makes it incredibly hard

for oscar pistorius to get bail. his defense team has to prove exceptional circumstances. what we expect to hear now after this lunch break is some sort of affidavit. written by oscar, spoken now by his legal team which will defend himself, will explain what he thinks happened that night and that might provide those so-called exceptional circumstances that will get him bail, this might take another day or two, that's for sure. >> we're looking forward to hearing more. >> unbelievable developments. 14 minutes after the hour. growing tensions between russia and the u.s. over the death of a west texas boy that officials call suspicious. max was born in russia and adopted by american parents. a russian official blames his death on inhuman abuse. david mattingly with the latest on the case. >> reporter: almost all of the

information we're getting is coming from the special human rights representative of the russian foreign ministry. he says that this child was a little over three years old when he died on january 21st of this year, a russian-born boy, adopted by american parents living in texas. in a statement, the official said i would like to draw your attention to another case of inhuman abuse of a russian child by u.s. adoptive parents. he claims the child suffered injuries to his head, legs and his abdomen and internal organs. the wounds he said could only be caused by strong blows. there is an investigation under w way. they are looking into this because of "the suspicious nature of the child's death." texas child protective services also investigating. the allegations include physical abuse and neglect. also, the sheriff's office

could feel like. for example what do budgets cuts feel like? in education, 14,000 teachers and staff face layoffs. criminal justice, all fbi workers could be forced to take 14 days off. national parks, better call ahead. if the sequester goes through, there could be reduced hours and services. and very likely last, travel. prepare for long every lines, wait time. slower security checks at the airport. you don't need to worry about medicare and social security, largely protected. when safety net programs like medicaid and food programs, exempt. military personnel, veterans affairs. veterans could be hit in other ways. they are a big part of the civilian workforce. here we are. it's irritating, the president will talk about it later this morning. try to prod them to move forward on this, surrounded by first responders, because presumably first responders budgets across the board would have to be cut. that would mean your services

charged with premeditated murder. awaiting a decision on bail. a hearing on a lunch break right now. expected to resume soon. >> joining success paul callan, a criminal defense attorney and a former new york city homicide prosecutor. and the news we're just getting in. just happening this morning, a judge this south africa has determined that they can go forward with a case of premeditated murder. what does that mean for oscar pistorius? >> bad things for oscar. he faces life in prison under south african law. they don't have the death penalty. he is unlikely he will get bail if there is substantial evidence that this is a premeditated planned murder. >> you are part of his defense team. how do you move forward now? >> press reports have said his defense is going to be this was around accident. he thought there was a burglar that had broken into his house and fired shots through the bathroom door. what came out at the hearing,

very interesting. the bathroom only 10 by 1 0 x 1. he gets up, put his artificial limbs on, walks 20 feet, 22 feet to the bathroom and then opens fire. his girlfriend is in the bathroom, hit by three shots. three of the four shots. if the girlfriend was staying with him that night, and he wakes up in the middle of the night, isn't he going to assume the girlfriend is in the bathroom? i'm sure that's what prosecutors will say. >> she did arrive between 5:00 and 6:00 p.m. and she was in her night gown. how do you argue that? >> i don't know. unless she got into the burglary field as opposed to the modeling field. blade runner has another problem here there could be another fact pattern that we don't know about. maybe she left. maybe there was a fight. i woke up in the middle of night, i heard noises thought there was a burglar in the bathroom. i fired shots in protection.

>> one of the most interesting thing, the reports in the press about this or that. one of the most interesting things about the south african legal system, it's so different than ours. no jury. explain the significance of that. >> it's a radically different system. a judge-based system. they use magistrates and if this case goes to trial, there will be a plea. a judge -- single judge will hear the case with two civilian adviser who's will sit in on the trial and they can give him their opinion, but he's not bound by it. very different than the american jury trial system. and, of course, the police are leaking a lot of information in this case. >> incredible. we see that happen in cases in the united states as well. not surprising, but it can deprive someone of a fair trial. >> no death penalty. >> no death penalty in south africa. eliminated a long time ago. that's off the table here. but the difference between a premeditated murder and south
